Summary of proposed rule

This rule proposal makes several changes to the commercial whale watching license structure, including defining paddle tours, businesses, and guides, and separating the licensing of paddle tour businesses from commercial watching businesses (where they were previously lumped together).

Scope and rationale for proposed rule

Following 2019 legislation creating commercial whale watching licenses (2SSB 5577; RCW 77.65.615), WDFW created a new WAC chapter (220-460) for the commercial whale watching license and rules applicable to license-holders (per RCW 77.65.620). This language was updated in 2021 due to ESB 5330. With the passage of ESSB 5371 in the 2023 legislative session, some language in chapter 220-460 WAC was no longer in alignment with RCW 77.65.615. This rule making amends chapter 220-460 WAC to align the rules with the statute, correct typographical errors, and clarify existing rule language.
